How to Appeal a Tax Assessment in Pakistan

When an assessment order creates a demand you believe is wrong, the law provides a tiered appeal structure. Using it correctly, and on time, is often the difference between relief and enforced recovery.
The first level is an appeal to the Commissioner Inland Revenue Appeals. It must be filed within the statutory period from the date of service of the order, accompanied by the prescribed fee and the grounds of appeal.
Grounds of appeal should be specific. Point to the provision misapplied, the evidence ignored, or the computation error made. Broad statements that the order is unjust carry little weight without supporting material.
If the first appeal does not resolve the matter, the next forum is the Appellate Tribunal Inland Revenue, which is an independent judicial body. Beyond that, references on questions of law lie to the High Court and ultimately the Supreme Court.
Filing an appeal does not automatically suspend recovery of the demand. A separate application for stay of recovery is usually necessary, and partial payment is often required as a condition.
An alternative route is the Alternative Dispute Resolution mechanism, which can be faster and less adversarial where both sides are willing to settle on reasonable terms.
Throughout the process, keep meticulous records of filings, acknowledgements and hearing dates. Procedural lapses defeat more appeals in Pakistan than weak substantive arguments do.
